CFTC reopens Polymarket probe; soldier's $400K insider bet tests agency's power over prediction markets.
The CFTC has reportedly started looking again into Polymarket. The case of a soldier accused of making $400,000 from insider bets now challenges the agency's power over prediction markets.
According to two people familiar with the matter who spoke to Reuters, the regulator is examining if Polymarket kept its 2022 pledge to prevent US users from trading. The investigation is also said to include the platform's CFTC-regulated American exchange.
Prosecutors accuse Master Sgt. Gannon Ken Van Dyke of betting on Polymarket using classified knowledge about the Maduro raid.
The soldier is said to have placed around $33,000 across 13 wagers ahead of the January operation that captured Venezuelan President Nicolás Maduro. Those bets resulted in $409,881 in profits, prosecutors say.

He is also said to have set up his account using a VPN, which hides where a user is located. Polymarket states that its terms forbid these methods.
Van Dyke has entered a not guilty plea. His legal team contends that the bets were event contracts rather than swaps, the derivatives overseen by the CFTC.
Judge Margaret Garnett turned down the motion to dismiss the case this week, Courthouse News reported. She determined that the swaps issue could not be settled at that stage.
As a result, the dispute moves toward a trial tentatively set for Dec. 7. Meanwhile, Polymarket says it revamped its controls and referred the soldier's activity to authorities.
Last year, however, the CFTC and Justice Department closed similar probes without charges. Polymarket disclosed it had bought a CFTC-licensed exchange a week after CEO Shayne Coplan said the inquiries had ended.
CFTC enforcement director David Miller said in March that he would aggressively police prediction markets. Separately, a New York lawsuit accuses Polymarket’s US operator of running an illegal gambling business.
Reuters notes the sector has surged under supportive US policy, though Democratic lawmakers have raised insider trading concerns. The House Oversight Committee is also running an insider trading probe that names Polymarket.
A trial win on the swaps theory could strengthen the CFTC’s footing over event contracts. A loss could narrow it, though one case may not settle the wider question.
