US election reshapes crypto policy landscape

Voters handed Democrats control of both chambers of Congress, complicating the crypto industry's push for clear federal regulation.

The cryptocurrency sector poured $195.8 million into the 2024 election cycle aiming for a more favorable Congress. Instead, voters gave Democrats control of both chambers, and the politician they tried to block with $40 million in attack ads is returning to Washington.

The impact extends far beyond digital wallets. Bitcoin investors, holders of crypto-related equities, and exchanges across the US all share a common goal: a comprehensive federal statute defining crypto oversight. The likelihood of securing such a law has just diminished.

Why Passing Crypto Legislation Got Tougher

1. Democratic support is now essential for every crypto bill.

According to PBS, Democrats flipped Senate seats in Republican strongholds like Texas, Kansas, Iowa, and Ohio. The new legislative session begins in January.

Ohio presents the most immediate challenge. Long-time industry critic Sherrod Brown, who previously chaired the Senate Banking Committee, has returned to the Senate. The crypto sector spent $40 million on advertisements attacking the senator two years ago, and he lost that race.

The crypto lobby has now spent about $95 million on one guy.

$40 million to beat Sherrod Brown in 2024.

More than $55 million this year to stop his comeback.

Brown is going back to the Senate.

Expensive lesson.

2. The CLARITY Act was struggling even before Democrats took the reins.

Aimed at determining the oversight agency for digital tokens and trading platforms, the CLARITY Act cleared the House in July 2025 by a 294-134 vote. The bill hit a dead end in the Senate, however, where a procedural vote failed 49–50 on September 15, according to law firm Orrick. The disputes centered on ethics rules for lawmakers' crypto assets and the nature of stablecoin yields, which banks fear could drain deposits.

3. Temporary agency rules persist without a federal statute.

Currently, the crypto sector operates mainly under guidelines set by government agencies, which a future administration could easily alter. Mary Cull of Cryptex Finance explained to American Banker that a Democratic Senate could make passing a comprehensive bill more complicated.

"In this administration, I think that crypto has been the darling," the American Banker reported, citing Cull.

4. Key committee gavels go to well-known crypto skeptics.

The American Banker reports that Senator Elizabeth Warren is expected to lead the Banking Committee, while Representative Maxine Waters is poised to chair the House Financial Services Committee. These panels control which crypto bills get hearings and can subpoena executives for testimony under oath.

HOW THE MID-TERM ELECTION IN THE US🇺🇸 , COULD AFFECT CRYPTO!!

Democrats won control of both chambers of the United States Congress in the November 3 midterm elections, according to race calls by the Associated Press.

The new Congress is sworn in on January 3 2027.

Until then…

5. Trump-linked crypto businesses face greater scrutiny.

Public Citizen's Bart Naylor anticipates Democratic lawmakers will target Trump's digital asset initiatives, potentially through the use of subpoenas. Congress has already launched an inquiry into World Liberty Financial, the Trump family's crypto enterprise.

"Democratic control also brings subpoena power and scrutiny of Trump linked crypto businesses, plus influence over confirmation of future nominees to regulatory posts," noted one user on X.

6. The Binance hack sharpens the focus on exchange security.

In an October 30 statement, Representative Waters referenced reports that Binance lost roughly $6.3 billion in a security breach the previous week.

Rep. Maxine Waters just weighed in on the Binance hack

She called it "a wake-up call to anyone who thinks the cryptocurrency industry can operate without strong accountability."

Her ask: stronger consumer protections, tougher cybersecurity standards, and real accountability.…

The representative also pointed out that Binance founder Changpeng Zhao invested more than $2 billion into World Liberty Financial before receiving a pardon from President Trump.

"Americans deserve to know their money is safe," she said.

Could Bitcoin Buck the Political Headwinds?

7. Historical trends and regulatory momentum offer a different narrative.

Dozens of Democrats voted in favor of the CLARITY Act in the House, highlighting bipartisan support. Stablecoins are already covered by the GENIUS Act, which became law in 2025. Rulemaking continues independently, with the SEC issuing draft crypto regulations in August and the CFTC submitting proposals for White House review in September, according to Orrick. Binding rules, however, remain at least a year off. Historically, markets have brushed off midterm outcomes. The S&P 500 has gained ground after every US midterm vote since 1982, and Bitcoin was up a year following the last few cycles. As election results came in during the overnight session, both Bitcoin and stock futures moved.

The industry's fundraising shows no signs of abating. Fairshake raised nearly $137 million for 2026 contests by June 30, according to FactCheck. In January, the politician it targeted most heavily in 2024 returns to the Senate.
